class=\"navtiao\"\u003e\u003ca name=\"tiao_1\"\u003e\u003c/a\u003e　　第一条　\u003c/span\u003e为了保障国家公务员的合法权利，优化国家公务员队伍，根据《国家公务员辞职辞退暂行规定》制定本办法。\u003cdiv class=\"TiaoYinV2\" id=\"div1\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_2\"\u003e\u003c/a\u003e　　第二条　\u003c/span\u003e国家公务员的辞职，是指国家公务员依照法律、法规规定，申请终止与国家行政机关的任用关系。\u003cdiv class=\"TiaoYinV2\" id=\"div2\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_3\"\u003e\u003c/a\u003e　　第三条　\u003c/span\u003e辞退国家公务员，是指国家行政机关依照法律、法规规定，解除其同国家公务员的任用关系。\u003cdiv class=\"TiaoYinV2\" id=\"div3\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_4\"\u003e\u003c/a\u003e　　第四条　\u003c/span\u003e国家公务员要求离开国家行政机关，不再担任国家公务员职务，可以向任免机关申请辞职。\u003cdiv class=\"TiaoYinV2\" id=\"div4\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_5\"\u003e\u003c/a\u003e　　第五条　\u003c/span\u003e国家公务员有下列情形之一的，不得辞职：\u003cbr\u003e　　（一）在涉及国家安全、重要机密等特殊职位上任职以及调离上述职位不满解密期的；\u003cbr\u003e　　（二）重要公务尚未处理完毕，而且须由本人继续处理的；\u003cbr\u003e　　（三）正在接受审查的；\u003cbr\u003e　　（四）按规定末满最低服务年限的。\u003cdiv class=\"TiaoYinV2\" id=\"div5\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_6\"\u003e\u003c/a\u003e　　第六条　\u003c/span\u003e国家公务员辞职按下列程序办理：\u003cbr\u003e　　（一）由本人向所在单位提出辞职申请，填写《国家公务员辞职申请表》；\u003cbr\u003e　　（二）所在单位提出意见，按照管理权限报任免机关；\u003cbr\u003e　　（三）任免机关人事部门审核；\u003cbr\u003e　　（四）任免机关审批，并将审批结果以书面形式通知呈报单位及申请辞职的公务员。\u003cdiv class=\"TiaoYinV2\" id=\"div6\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_7\"\u003e\u003c/a\u003e　　第七条　\u003c/span\u003e国家公务员辞职，任免机关应当在接到辞职申请的三个月内予以审批。超过三个月未予批复的视为同意辞职，任免机关应予办理辞职手续。\u003cbr\u003e　　国家公务员在辞职审批期间不得擅自离职，对擅自离职又不听劝告的，给予开除处分，不准重新录用到国家机关工作。\u003cdiv class=\"TiaoYinV2\" id=\"div7\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_8\"\u003e\u003c/a\u003e　　第八条　\u003c/span\u003e国家公务员辞职后，两年内到与原单位有隶属关系的国有企业或营利性的事业单位工作的，须经原任免机关批准。\u003cdiv class=\"TiaoYinV2\" id=\"div8\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_9\"\u003e\u003c/a\u003e　　第九条　\u003c/span\u003e国家公务员有下列情形之一的，应予辞退：\u003cbr\u003e　　（一）连续两年考核被确定为不称职的；\u003cbr\u003e　　（二）不能胜任现职工作，又不接受其他工作安排的；\u003cbr\u003e　　（三）因单位调整、撤销、合并或者缩减编制员额需要调整工作，本人拒绝合理安排的；\u003cbr\u003e　　（四）旷工或者无正当理由逾期不归连续超过15天，或者一年内累计超过三十天的；\u003cbr\u003e　　（五）不履行国家公务员义务，不遵守国家公务员纪律，经多次教育仍无转变或者造成恶劣影响，又不宜给予开除处分的；\u003cbr\u003e　　（六）由于其它原因不适宜在行政机关工作的。\u003cdiv class=\"TiaoYinV2\" id=\"div9\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_10\"\u003e\u003c/a\u003e　　第十条　\u003c/span\u003e国家公务员有下列情形之一的，不得辞退：\u003cbr\u003e　　（一）因公致残并确认丧失工作能力的；\u003cbr\u003e　　（二）患严重疾病或负伤正在进行治疗的；\u003cbr\u003e　　（三）女性公务员在孕期、产期及哺乳期内的。\u003cdiv class=\"TiaoYinV2\" id=\"div10\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_11\"\u003e\u003c/a\u003e　　第十一条　\u003c/span\u003e辞退国家公务员按下列程序办理：\u003cbr\u003e　　（一）所在单位在核实事实的基础上，经领导集体研究提出建议，填写《辞退国家公务员审批表》，按管理权限报任免机关；\u003cbr\u003e　　（二）任免机关人事部门审核；\u003cbr\u003e　　（三）任免机关审批。做出辞退决定的，以书面形式通知呈报单位和被辞退的国家公务员，同时抄送同级政府人事部门备案。\u003cbr\u003e　　县级以下国家行政机关辞退国家公务员，须报经县人民政府批准。\u003cdiv class=\"TiaoYinV2\" id=\"div11\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_12\"\u003e\u003c/a\u003e　　第十二条　\u003c/span\u003e国家公务员辞职或者被辞退，应在批准之日起的半个月内办理完公务交接手续和辞职、辞退手续，必要时应接受财务审计。对拒不办理公务交接手续和不接受财务审计的，给予开除处分。\u003cdiv class=\"TiaoYinV2\" id=\"div12\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_13\"\u003e\u003c/a\u003e　　第十三条　\u003c/span\u003e国家公务员被辞退后，五年内不准重新录用到国家行政机关工作。\u003cdiv class=\"TiaoYinV2\" id=\"div13\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_14\"\u003e\u003c/a\u003e　　第十四条　\u003c/span\u003e国家公务员辞职或被辞退后，不再保留国家公务员身份，自批准之月的下月起停发工资。\u003cdiv class=\"TiaoYinV2\" id=\"div14\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_15\"\u003e\u003c/a\u003e　　第十五条　\u003c/span\u003e被辞退的国家公务员，按国家有关规定享受失业保险或者按有关规定领取一定的辞退费。在本市失业保险制度建立之前，被辞退的国家公务员按每月185元标准领取辞退费。辞退费按月发放。\u003cbr\u003e　　具体发放标准：工作年限满一年不满二年的，发给三个月的辞退费；工作年限满二年的，发给四个月的辞退费；工作年限满二年以后，每增加一年增发一个月的辞退费，但最多不得超过二十四个月。\u003cdiv class=\"TiaoYinV2\" id=\"div15\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_16\"\u003e\u003c/a\u003e　　第十六条　\u003c/span\u003e被辞退的国家公务员重新就业，出境、出国定居，考入中等以上学校或被劳动教养、判刑的，停发辞退费。\u003cdiv class=\"TiaoYinV2\" id=\"div16\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_17\"\u003e\u003c/a\u003e　　第十七条　\u003c/span\u003e国家公务员辞职或被辞退后重新就业，辞职、辞退前和重新就业后的工龄合并计算。\u003cdiv class=\"TiaoYinV2\" id=\"div17\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_18\"\u003e\u003c/a\u003e　　第十八条　\u003c/span\u003e《国家公务员辞职申请表》、《辞退国家公务员审批表》装入本人档案。被辞退的国家公务员的档案存放在各级政府人事部门所属的人才交流中心。国家公务员辞职后，档案由原单位按规定转至有关单位。\u003cdiv class=\"TiaoYinV2\" id=\"div18\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_19\"\u003e\u003c/a\u003e　　第十九条　\u003c/span\u003e国家公务员对辞职未被批准或者被辞退不服的，根据国家有关规定提出申诉。\u003cdiv class=\"TiaoYinV2\" id=\"div19\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_20\"\u003e\u003c/a\u003e　　第二十条　\u003c/span\u003e在试用期间的人员，不执行此办法。\u003cdiv class=\"TiaoYinV2\" id=\"div20\"\u003e\u003c/div\u003e\u003cspan anchor=\"anchor\" class=\"navtiao\"\u003e\u003ca name=\"tiao_21\"\u003e\u003c/a\u003e　　第二十一条　\u003c/span\u003e本办法由市人事局负责解释。\u003cdiv
